By accessing or using BrandNamer at brandnamer.io ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. Description of Service

BrandNamer is a free, AI-powered tool that generates brand name suggestions for startups and products. It also checks real-time domain availability (.com, .io, .co) via public RDAP registry lookups. No account creation is required to use the Service.

3. User Accounts

BrandNamer does not require account registration. There are no usernames, passwords, or stored profiles. Usage limits are enforced via rate limiting (5 generations per day on the client, 10 requests per IP per hour on the server).

4. User Responsibilities & Acceptable Use

You agree not to:

  • Circumvent or attempt to bypass rate limits
  • Use the Service for any unlawful purpose
  • Submit harmful, abusive, or malicious content to the name generator
  • Scrape, crawl, or use automated tools to extract data from the Service beyond normal usage
  • Attempt to interfere with or disrupt the Service's infrastructure

5. AI-Generated Content Disclaimer

Brand names generated by BrandNamer are AI-generated suggestions, not legal or professional advice. Specifically:

  • No trademark guarantee — generated names may conflict with existing trademarks. You are solely responsible for conducting a trademark search (e.g. via the USPTO, EUIPO, or your local registry) before registering or using any name commercially.
  • No accuracy guarantee — AI output may be imperfect, inappropriate, or not suitable for your use case. We do not guarantee the quality, originality, or fitness of any generated name.
  • Domain availability is point-in-time — a domain shown as "available" may be registered by someone else at any time before you complete your purchase.

6. Intellectual Property

The BrandNamer website, design, code, and branding are owned by us. You may not copy, modify, or redistribute any part of the Service without permission.

Generated name suggestions are not claimed by BrandNamer — you are free to use them. However, we make no representation that a generated name is available for trademark registration or free from third-party rights.

7. Affiliate Links & Advertising

BrandNamer contains affiliate links to Namecheap. When you register a domain through these links, we may earn a commission at no extra cost to you. The Service also displays ads via Google AdSense. These are clearly disclosed in accordance with FTC guidelines. Affiliate relationships do not influence the names generated by the AI.

8. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRANDNAMER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM YOUR USE OF THE SERVICE. SINCE THE SERVICE IS FREE, OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO $0.

9. Indemnification

You agree to indemnify and hold harmless BrandNamer and its operators from any claims, damages, losses, or expenses (including legal fees) arising out of your use of the Service, your violation of these Terms, or your use of any generated name that infringes on a third party's rights.

10. Termination

We reserve the right to block access to the Service for any user who violates these Terms, abuses rate limits, or uses the Service in a way that harms the experience for others. Since no account exists, termination means blocking the offending IP address.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of the United States. Any disputes arising from these Terms or your use of the Service shall be resolved through good-faith negotiation first. If negotiation fails, disputes will be resolved in the courts of the United States.

12. Modifications

We may update these Terms at any time. Changes will be posted on this page with an updated date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
